Terms of Service

1. Who we are
Pitchwerx ("Pitchwerx," "we," "us") is a private baseball pitching training facility operated by Royce Carlton and Pitchwerx coaches at The Yard Baseball Complex in Greenfield, Indiana. These Terms govern your use of the Pitchwerx facility, training sessions, online portals (parent / player / trainer), the remote training program, the website at PitchWerxOS.com, and any related services (collectively, the "Service").
2. Acceptance and parental consent
By creating an account, booking a session, or otherwise using the Service, you confirm that you are at least 18 years old. If the athlete is under 18, a parent or legal guardian must create and manage the account on the athlete's behalf and accepts these Terms for both themselves and the athlete. The parent is responsible for the athlete's use of the Service.

4. Payment
Payment is taken via Venmo (manually confirmed by a coach) or, for limited cases, via an issued trainer code that waives payment. Bookings are held for 15 minutes pending Venmo confirmation; an unpaid hold may be released and the slot reopened. Prices are in U.S. dollars and may change with reasonable notice.
5. Assumption of risk and waiver
Baseball pitching, throwing programs, and strength work involve inherent physical risks, including muscle and joint injury. By using the Service you acknowledge these risks and assume them on your own (and the athlete's) behalf. Pitchwerx coaches make programming recommendations based on the information you provide; you are responsible for consulting a medical professional before starting, modifying, or continuing any training program, especially after injury.
To the maximum extent permitted by Indiana law, you release Pitchwerx, its coaches, and The Yard Baseball Complex from claims arising out of training-related injury, lost equipment, or scheduling conflicts, except where caused by gross negligence or willful misconduct.
6. Media and likeness
Coaches may record sessions for instructional purposes and may, with your consent, publish performance graphics and athlete share cards. You may revoke media consent at any time by writing to carltonrbaseball@gmail.com. Verified data displayed on the public leaderboard or athlete share pages can be de-listed on request.
7. Account, codes, and security
Keep your password and player codes private. You are responsible for activity under your account. We may suspend access for behavior that disrupts other athletes, attempts to circumvent paid features, or violates these Terms.
8. Acceptable use
Don't use the Service to: harass coaches or other families, scrape data, attempt to access another account, upload content you don't own, or submit knowingly false information about an athlete.
9. Changes to the Service or these Terms
We may update the Service and these Terms from time to time. Material changes will be posted on this page with a new "last updated" date. Continued use after a change constitutes acceptance of the updated Terms.
10. Governing law
These Terms are governed by the laws of the State of Indiana, without regard to its conflict-of-laws rules. The exclusive venue for any dispute is the state or federal courts located in Hancock County, Indiana.
